Beta terms
These terms cover taking part in the Keepcompany beta: who may join, what you may and may not do, and what happens to your data. By signing in and using Keepcompany, you agree to them. Please read them before you start.
Who you are agreeing with
Keepcompany is run by Pascal Harmes, a sole trader (Einzelunternehmer), c/o IP-Management #12366, Ludwig-Erhard-Straße 18, 20459 Hamburg, Germany. Email info@keepcompany.ai. The Impressum has the full provider details.
A company is being founded to run Keepcompany. When it is registered, it takes over the service and these terms. We will tell you before that happens, and you can delete your account if you don't want to continue with the company.
What the beta is
Keepcompany lets you talk with AI characters who remember you. You can make your own characters, and the characters can send you pictures.
The beta is by invitation only. You can take part only with an invitation from us, and an invitation is for you alone: don't share it or your account.
Keepcompany is still in development. During the beta, things will break, change or be switched off while we fix them, and characters may change. If you are a tester, the tester agreement you accepted in the app also applies; where it says something more specific, it applies.
You must be 18 or older
Keepcompany is only for people aged 18 and over. When you first sign in, you confirm that you are. If you tell us you are under 18, or we find that an account belongs to someone under 18, we close the account and delete its sign-in details within 7 days.
If something in a chat suggests that you may be under 18, the characters stop replying normally and send only a short fixed message until a person on our team has looked at it. If the flag was a mistake, the team lifts it.
Characters must be adults too. Age details on a character are checked when it is made or imported.
The characters are AI
Every character on Keepcompany is artificial intelligence. No person writes the replies. Pictures and audio the characters send are machine-made and marked as AI-generated.
What a character says is invented. It can be wrong, forget things, or make up facts, including facts about Keepcompany, its rules or your data. It is not advice: don't rely on a character for medical, legal, financial or other professional advice.
Keepcompany is not a crisis service. If you are in danger or in crisis, contact your local emergency number or a helpline. The app shows numbers when it notices you might need them.
What you may not do here
Some things are never allowed, at any setting, for anyone: anything sexual involving minors or characters who read as minors; sexual content about real, identifiable people; non-consent; incest; bestiality (real animals; anthro and fantasy characters are fine); sexual gore; necrophilia; and scat.
Also not allowed:
- anything illegal;
- using characters to harass, threaten or defame anyone;
- trying to reach other people's data, or to break, overload or get around the service's protections, unless you are a tester in the adversarial group and stay within the limits in your tester agreement;
- removing or changing the marks that identify generated pictures and audio;
- using bots, scripts or other automation to chat, including replaying conversations through the app or our API. Importing and exporting your own data through the API is fine, within its rate limits;
- sharing your account or your invitation.
Software that runs outside the AI model enforces these limits, so a character cannot be talked past them. When a message or picture hits one of them, it does not go through, and the service tells you so in its own words. The content policy says what adults can do here, what the 18+ area adds and who can use it, and what happens when a rule is broken. The Safety page explains the checks.
The picture model's own rules
The pictures are made with SDXL, an image model released under the CreativeML Open RAIL++-M licence, and with models built on it. That licence lets us use the model only if everyone who uses it through us keeps to its use restrictions (Attachment A of the licence). They apply to you as part of these terms. You may not use Keepcompany's pictures, or the way they are made:
- in any way that breaks any applicable law;
- to exploit or harm minors in any way, or to try to;
- to create or spread false information meant to harm others;
- to create or spread personal information that can be used to harm someone;
- to defame, disparage or harass others;
- for fully automated decisions that harm someone's legal rights or create or change a binding obligation;
- to discriminate against or harm people or groups based on their social behaviour or their known or predicted personal or personality traits;
- to exploit the vulnerabilities of a group of people because of their age or their social, physical or mental characteristics, in a way that changes how someone in that group behaves and causes or is likely to cause them or someone else physical or psychological harm;
- to discriminate against people or groups based on legally protected characteristics;
- to give medical advice or interpret medical results;
- to produce information for use in the justice system, law enforcement, or immigration or asylum processes, such as predicting that someone will commit fraud or a crime.
If the licence's own wording and this summary differ, the licence's wording applies.
No payment in the beta
Nothing is charged during the beta, and no plan can be bought. Every plan is free in the beta: your invitation comes with one, and if the app lets you pick another, that is free too. Plans have daily limits; when a limit is reached, the characters stop answering until it resets.
Daily limits and fair-use rate limits apply to every plan, so the service stays quick for everyone.
Nothing turns into a paid subscription unless you choose one yourself. Paid plans open after the beta, under separate terms that we will show you before you can buy anything.
The beta may change or end
The beta runs from 9 to 23 November 2026. We can change it, pause it, or end it earlier.
When the beta ends, your account, characters, memories and chats stay and carry on into the launch. Your account then moves to the Free plan. Nothing is deleted at that point: anything beyond the Free plan's limits is archived and comes back if you later upgrade.
Because this is a beta, something can still go wrong despite backups. Keep your own copy of anything that matters to you; the app lets you export it at any time.
Your data, export and deletion
The privacy notice says what we store, why, who else handles it, and for how long. It is part of how Keepcompany works, but it is not part of these terms, and these terms do not change it.
- Export: you can download your conversations, memories and characters from inside the app at any time.
- Deleting a character: it is hidden at once and erased for good after 14 days. Until then you can restore it.
- Deleting your account: your account is closed at once and erased for good after 7 days. Until then you can restore it by signing in.
- Unused accounts: a free account you don't sign in to for 30 days becomes dormant. After 12 more months it is deleted, with warning emails 30 and 7 days before. Signing in at any time before then brings it back.
- Records the law makes us keep, such as invoices, are kept for as long as the law requires, and for nothing else. Copies inside our backups are kept for up to five weeks.
We don't read your chats. We see a chat only if you send it with Report a problem, or if you switch on logging for a character. Logging and training use are both off unless you switch them on. Each is a separate choice in the app, not part of these terms.
Your characters, and what the AI makes
What you write and the characters you make stay yours. You allow us to store, process, back up and show them to you, and to the people you share or publish them with, for as long as that is needed to run Keepcompany for you. This permission ends when you delete them, except for copies in backups, which are gone within five weeks.
You may only upload or write material you have the right to use. We may remove content that breaks these terms or the law, and we tell you why.
You may use the replies and pictures the characters send you for your own purposes, within these terms and the picture model's rules above. Kit and the other characters we made, and the stories and settings we provide, are ours. You may use them inside Keepcompany.
If you give us feedback, reports or ideas, we may use them to improve Keepcompany without owing you anything for them.
Reporting something, and complaints
You can report a message, a picture, a character or an account:
- in the app: choose Report a problem on any message or character;
- without an account: email abuse@keepcompany.ai. Anyone can write.
Tell us what the content is, where it is, and why you think it breaks the law or our rules. People on our team read reports, not the AI. We confirm receipt straight away if we can reach you, and decide within 7 business days. Illegal content, and anything involving minors, is dealt with as soon as we see it. We tell you and the person whose content it was what we decided and why. Content that sexualises minors is removed at once and reported to the authorities.
If you disagree with a decision, whether you reported the content or it was yours, you can appeal within 6 months: reply to our decision email, or write to abuse@keepcompany.ai with "Appeal" in the subject. A different person from the one who made the first decision looks at it within 14 days. If we got it wrong, we put it right.
You can also take a dispute about our decision to a certified out-of-court dispute settlement body; the European Commission publishes the list. You can complain to the Bundesnetzagentur, Germany's Digital Services Coordinator. Your right to go to court is not affected.
Our single point of contact for users and for authorities under the EU Digital Services Act is abuse@keepcompany.ai. You can write to us in English or German.
Ending your access
You can stop at any time and delete your account in the app, or ask us to by writing to privacy@keepcompany.ai.
We can suspend or close an account if its user breaks these terms seriously or repeatedly, or if the law requires it. We tell you why, unless the law stops us, and you can appeal as described above. We can also end everyone's access when the beta ends, as described above.
If an account seems to be chatting by automation, a person on our team looks at it before anything happens. We may then suspend or close the account, and we tell you why. You can appeal by writing to support@keepcompany.ai.
Liability
We are fully liable for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
For damage caused through slight negligence, we are liable only if we breach an essential obligation: one that makes the service possible in the first place and that you may rely on. In that case our liability is limited to the damage typical for this kind of service that could be foreseen when you joined.
What a character says is not our advice or our statement. This does not exclude our liability if a safety function of ours is defective.
Changes to these terms
We may change these terms, for example when a feature changes or the law requires it. We tell you in the app before a change applies. If a change matters to you, we ask you to agree to it again; you don't agree to it just by carrying on. If you don't agree, you can stop and delete your account.
Law and contact
German law applies. If you live in another country, you keep the protection of the mandatory consumer law of the country where you live.
We are not obliged to take part in dispute resolution proceedings before a consumer arbitration board, and we don't.
